These Terms apply to all products displayed on the Site, including items marked as out of stock. While we aim to ensure all product descriptions, images, and information are as accurate as possible, we cannot guarantee complete accuracy. You acknowledge that purchases are made at your own risk.

We reserve the right to modify, reject, or cancel orders at our discretion. If payment has already been processed for a cancelled order, a full refund will be issued. It is your responsibility to monitor your payment method to confirm receipt of any refund.

Shipping & Delivery

Purchased goods will be delivered using one of the following methods:

  • Freight Delivery: Estimated 5–10 business days

  • Warehouse Pickup: Estimated 2–5 business days

Delivery times are estimates only and may vary due to unforeseen circumstances. Business days exclude weekends and public holidays.

Delivery charges are payable in addition to product prices.

For international deliveries, orders may be subject to import duties and taxes imposed by the destination country. These charges are the responsibility of the customer. We are not liable for unpaid duties or customs delays.

You must provide a complete and accurate delivery address. We are not responsible for delivery issues caused by incorrect or incomplete information.


Refunds for Goods

Refund requests must be submitted within 5 days of receiving your order.

Refunds may be accepted if:

  • The item is broken

  • The item does not match the description

  • The item is incorrect in size

Refunds do not apply to:

  • Rugs


Consumer Protection

Nothing in these Terms limits your rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other applicable consumer protection legislation. Where these laws apply, they take precedence over any conflicting provisions in these Terms.


Limitation of Liability

Modern Rugs & Furniture, including its directors, officers, employees, agents, and affiliates, will not be liable for any loss, damage, claim, or expense arising from your use of the Site.


Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Modern Rugs & Furniture and its representatives from any claims, losses, damages, liabilities, or legal expenses arising from your use of the Site or breach of these Terms.


Governing Law

These Terms are governed by the laws of the State of QLD, Australia.


Dispute Resolution

If a dispute cannot be resolved informally, both parties agree to attempt resolution through non-binding mediation first. If mediation fails, the matter will proceed to arbitration, and the arbitrator’s decision will be final and binding.

Both parties retain the right to:

  • Bring claims in small claims court

  • Seek injunctive relief or remedies for intellectual property infringement

The costs of mediation or arbitration will be borne by the unsuccessful party.


Additional Terms

Replacements are not offered unless returned goods meet all eligibility requirements.


Severability

If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision will be removed without affecting the remaining Terms.


Changes to These Terms

We may update these Terms from time to time to reflect legal requirements or operational changes. Updates will be communicated via email or posted on the Site.
